Sale of property

Cadastral plan of my property is not conforming, can I sell the same?
It depends what kind of difference there is from the real state of the property. We suggest to call a technician to verify and decide how to act. Anyway, the plan has to be conform before final purchase contract (rogito notarile).

Am I obligated to produce Energy certificate to sell my house?
Almost all the notaries do ask for this certificate, even if in Veneto, since there is no regional law about, private citizens can still use self-certification/self-declaration.

Is it possible to sell an apartment without electric system certificate?
Yes, if both parties agrees about it.

Is it possible to sell a property with building abuse?
No, it is necessary to amend the tort or to restore the original condition.

Does exist a price per square meter in Venice?
Too many are the factors that affect the price of an apartment in Venice in order to establish a precise value per sqm. Position, level on the ground, conditions, view, inner height, condition of the building and its historic value can determine the cost of a property.

Are all the ground floor apartments subject to flooding?
It depends on the area and, more precisely on the level on the sea. There are many ground floor apartments exempt from flooding or restored so that are protected from high water.

Is legitimate to ask for a higher price for sale rather than paying agency commission?
The well known "supero" is ethically un fair and, most of all, illegal, because commission has to be calculated according to the rules of Camera Di Commercio seated in the relative City.

Renting a property

Is it possible to rent my house for a shorter period than 4 years?
Of course, it is only necessary to explain in the contract the reason of a temporary contract instead of a long term one.

Who pays for the annual clearing of heating system?
The ordinary works, among them there is also the annual cleaning of the heating system, are duty of the tenant, the proprietor has to pay the extraordinary ones.

I would like to rent a property within two months, is it possible to ask to the agency to “book” the apartment? I would obviously pay for the three month rents.
Yes. It is possible to sign a proposal with a month rental as deposit, stating the date of the beginning of the rental (within two months) and the date for the signature of the agreement. Afterward it would be up to the proprietor to decide to accept the proposal or not.

I would like to know if the proprietor is right since she refuses to give me back the deposit, because she accuses me that I caused damages to the property.
The proprietor is obligated to give back the deposit at the end of the rent, but only if the tenant respected all the rules of the contract and kept the apartment in good condition; otherwise the deposit is a guarantee for the proprietor.

How do we have to divide expenses among proprietor and tenant?
The article n. 1576 c.c. establishes, as general measure, that the proprietor has to care all the required works, except small ones, because the tenant has to care about them. All the ordinary expenses are depending on the tenant, while the proprietor has to pay for extraordinary expenses.

What does it happens if the tenant keeps staying in the property longer than the end of the contract?
If the tenant delays with setting the property free, the article n. 1591 c.c. establishes that he’s obligated to pay for the period he uses the property, until he does set it free. In this case the name of the payment is not “rent” anymore, but compensation for occupancy.

What the proprietor has to do in order to withdraw from the contract?
In case a proprietor intended to withdraw a housing contract, has to inform the tenant at least six months before the expiration date, sending a letter with advice of delivery, specifying the reason for cancellation.

What does happen if I sell a rented property?
The lease agreement doesn’t end with the sale. The tenant has just to refer to the new proprietor for everything that concerns the agreement.

Is it possible to stipulate temporary contracts with tenants that are not students?
Yes, it is only necessary to attach to the contract the documentation certifying the reason of the temporary lease.

In which cases it is possible to evict a tenant?
The proceeding to obtain validation for an eviction can be settled from the proprietor In the following cases:
END OF THE CONTRACT: when the contract is empire or is going to expire;
ARREARAGE: in case the tenant doesn’t pay the rent, after 20 days from the date of the payment, or in case the tenant do not pays for utilities or other expenses, only if the amount is more than two months’ rent.

Who cares about registration of the contract, and who pays for it?
The amount is equally divided among proprietor and tenant, while the tenant has to pay for the legal stamps for the contract but both are responsible for the payment of the whole sum. The contract should be registered from the proprietors, but our agency cares about it.
